At TKorber LLC, we protect the originality and integrity of all fine art, including paintings, murals, sketches, mixed media, digital works, and other artistic creations. This policy outlines our stance on using artificial intelligence (AI) technologies and protections to safeguard our intellectual property and ensure ethical practices in art creation and distribution.
1. Protections
1.1 Original Artwork Ownership
All works created by TKorber LLC, including but not limited to paintings, murals, large-scale canvases, sketches, digital renderings, and mixed media, are original and protected. Using these works for inspiration is welcome, but direct copying, reproduction, or creating look-alike derivatives is not allowed without written authorization and permission by artist, Teresa Korber.
1.2 Murals and Public Art
Murals and public artworks may exist in public spaces, but their designs remain the property of TKorber LLC. These works can inspire creativity but reproducing them for commercial purposes or as direct imitations requires written consent.
1.3 AI-Generated Derivatives
AI tools can be great for sparking ideas, but they must not be used to closely replicate or recreate TKorber LLC’s artworks without prior approval. General inspiration is fine, but the originality of the work must be respected.
1.4 Moral Rights
TKorber LLC retains the right to be credited for all original artworks. Any approved use of the work, including public display, reproduction, or distribution, must properly credit TKorber LLC as the creator. Altering, distorting, or modifying the artwork without permission is prohibited.
1.5 Integrity of the Work
TKorber LLC maintains the right to protect the integrity of its works. Any alteration, distortion, or modification of the artwork without permission is prohibited if it could harm the artist’s reputation or the original intent of the work.
2. Use of AI by TKorber LLC
2.1 AI for Inspiration
TKorber LLC occasionally uses AI tools to explore ideas or concepts, but all final artworks are hand-created using traditional methods. AI is treated as a tool for inspiration, not a substitute for craftsmanship.
2.2 Ethical Use
While AI might influence brainstorming, every final piece is a unique creation. TKorber LLC ensures that its use of AI respects the originality and rights of other creators.
3. Digital Use and Reproduction
3.1 Digital Reproduction
Any digital reproduction of TKorber LLC’s works must be approved. This includes posting images online, selling digital prints, or using them in digital media like websites or advertisements.
3.2 Online Platforms
If TKorber LLC’s works are displayed or sold on third-party platforms (such as social media or online galleries), these platforms are required to respect the artist’s copyright and prevent unauthorized use.
4. Commissioned Works
4.1 Ownership of Commissioned Art
For commissioned works, the client owns the physical piece, but TKorber LLC retains the copyright to the work. TKorber LLC has the right to use images of commissioned works in its portfolio, social media, or other promotional materials unless otherwise agreed.
4.2 Exclusivity
Commissioned works may be exclusive or non-exclusive. If exclusive, the design cannot be reproduced for other clients. The terms of exclusivity will be defined in the commission agreement.
5. Licensing for Commercial Use
5.1 Commercial Licensing
TKorber LLC may license its artworks for commercial use (e.g., for merchandise, advertising, or other commercial products). Licensing agreements will be negotiated separately and will define the scope, time, and territory for commercial use.
5.2 Royalty Agreements
In cases where artwork is licensed commercially, TKorber LLC may include a royalty structure. This ensures continued compensation for any ongoing sales or use of the artwork.
6. Enforcement
6.1 Monitoring and Reporting
TKorber LLC will actively monitor digital platforms for unauthorized use of its works. Any unauthorized use, including AI-generated replicas, will result in immediate legal action.
6.2 Legal Recourse
Violations of this policy will be pursued to the fullest extent of the law, including cease-and-desist orders, seeking financial damages, and other necessary legal action.
7. Client and Partner Compliance
7.1 Contracts with Clients
When appropriate, clients and collaborators will sign agreements acknowledging their compliance with this AI Use and Protection Policy. This includes agreements for commissioned works like murals and other custom artwork.
7.2 Third-Party Platforms
Any third-party platforms that display TKorber LLC’s works with its permission must have policies in place to prevent unauthorized AI usage and ensure copyright protection.
8. Policy Updates
This policy may be revised periodically to reflect changes in technology and protection laws. Updates will be published on TKorber LLC’s official website.
